GDPR: DATA PRIVACY NOTICE FOR TYSON’S SHIPS RIGGERS LTD

Tyson’s’ Ships Riggers Limited are committed to protecting and respecting your privacy, in accordance with the General Data Protection Regulation (GDPR), we have implemented this privacy notice to inform you, our suppliers, of the types of data we process about you. We also include within this notice the reasons for processing your data, the lawful basis that permits us to process it, how long we keep your data for and your rights regarding your data. This policy together with our website privacy policy and any other documents referred to on it will help you the supplier to understand our views and practices regarding your personal data and how we will treat it.

The rules on processing of personal data are set out in the General Data Protection Regulation (the “GDPR”).

  1. DEFINITIONS

Data controller – A controller determines the purposes and means of processing personal data.

Data processor – A processor is responsible for processing personal data on behalf of a controller.

Data subject – Natural person

Categories of data – Personal data and special categories of personal data

Personal data – The GDPR applies to ‘personal data’ meaning any information relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier (as explained in Article 6 of GDPR). For example name, passport number, home address or private email address. Online identifiers include IP addresses and cookies.

Special categories personal data – The GDPR refers to sensitive personal data as ‘special categories of personal data’ (as explained in Article 9 of GDPR). The special categories specifically include genetic data, and biometric data where processed to uniquely identify an individual. Other examples include racial and ethnic origin, sexual orientation, health data, and trade union membership, and political opinions, religious or philosophical beliefs.

Processing – means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Third party – means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.

DATA PROTECTION PRINCIPLES

Under GDPR, all personal data obtained and held by us must be processed according to a set of core principles. In accordance with these principles, we will ensure that:

  1. processing is fair, lawful and transparent
  2. data is collected for specific, explicit, and legitimate purposes
  3. data collected is adequate, relevant and limited to what is necessary for the purposes of processing
  4. data is kept accurate and up to date. Data which is found to be inaccurate will be rectified or erased without delay
  5. data is not kept for longer than is necessary for its given purpose
  6. data is processed in a manner that ensures appropriate security of personal data including protection against unauthorised or unlawful processing, accidental loss, destruction or damage by using appropriate technical or organisation measures

  1. THE CATEGORIES OF PERSONAL DATA CONCERNED

We process several categories of personal data on our suppliers in order to carry out effective and efficient processes.

Specifically, we process/hold the following types of data:

  • Suppliers Business Name
  • Address
  • Contact numbers
  • Email address
  • Bank Details

We have obtained your personal data from only you the supplier.

  1. THE PURPOSE(S) OF PROCESSING YOUR PERSONAL DATA

The purpose of processing you the suppliers personal data are for the following:

  1. Suppliers, business name and address: these are needed so we can place orders with suppliers on our system, and so we know where to send payment of your invoices.
  2. Contact numbers: these are needed so that we can contact suppliers to place and follow up any orders we have with suppliers.
  3. Email addresses: these are needed so that we can send official orders in writing to suppliers.
  4. Bank details: are required to enable us to make BACS payments, these are needed to be processed to enable us to pay supplier’s invoices.
  5. The main purpose for all of this data needing to be processed is that we (the customer) can enter into a contract with (the supplier) this contract being the exchange of goods and services.

When you contact us via our website enquiry form https://www.tysonsriggers.co.uk/contact/ we need your consent to use your data you provide in the contact form to communicate with you, in particular for marketing purposes.  You have the option at any time to withdraw your consent by contacting Mr Jonathan Tyson DPO on 01472 347065

Legitimate interest

We have a legitimate interest in processing,collecting and retaining the following data Supplier/business name, company address, contact telephone/fax numbers and email addresses where permitted and bank details, for the processing of our purchase orders and, purchase invoices. You have the option to opt out of your personal data being processed for these means at any time by getting in contact with us.

As some of our suppliers are also customers of Tyson’s Ships Riggers Ltd we may contact you reference special offers by e-mail, telephone or post.  You have the right to ask for your data to be removed from our marketing data base and no more offers to be sent.

We have a legitimate interest in marketing our goods to existing customers to increase sales.

Processing necessary for the performance of a contract with the data subject or to take steps to enter into a contract
When we place an order by telephone, or email we are entering into a contract with you (the supplier) and us the customer. The suppliers part of the contract is to complete and deliver our order to us on time, and our part as the customer is to pay you the supplier within the agreed terms that we have stated, this is agreed at the time by telephone or email.

 

  1. SHARING YOUR PERSONAL DATA

As some of our suppliers are also customers of ours, in the course of processing orders, we may be required to share your data, example name and address, to 3rd parties, for example courier services   Any information passed to these parties will be handled as per the GDPR guidelines and will only be relevant to the requirements of providing our services.

  1. HOW LONG DO WE KEEP YOUR PERSONAL DATA?

We only keep your data for as long as required which will be at least for the duration that you are a supplier of Tyson’s Ships Riggers Ltd. We update our supplier list constantly and soon as we find out that a company is no longer trading we take them off our system. If you are a supplier and also a customer of Tyson’s Ships Riggers Ltd please refer to this section in our customer privacy notice.

  1. PROVIDING US WITH YOUR PERSONAL DATA

We require your personal data as it is a requirement necessary to enter into a contract with the supplier the contract being the exchange of goods and services between us the customer and you the supplier. If we do not have this information we would not be able to process our purchase orders for you to supply goods to us.

Unless subject to an exemption under the GDPR, you have the following rights with respect to your personal data:

  1. The right to be informed about the data we hold on you and what we do with it.
  2. The right to access the personal data that we hold reference you.
  3. The right to rectification regarding any data held by us that is found to be inaccurate or out of date.
  4. The right to erasure your personal data is erased where it is no longer necessary to retain such data.
  5. The right to restrict processing, where there is a dispute in relation to the accuracy or processing of your personal data, to request a restriction is placed on further processing.
  6. The right to data portability you can request that we provide you with your personal data and where possible, to transmit that data directly to another data controller, (known as the right to data portability), (where applicable i.e. where the processing is based on consent or is necessary for the performance of a contract with the data subject and where the data controller processes the data by automated means).
  7. The right to object to the processing of personal data, (where applicable i.e. where processing is based on legitimate interests or the performance of a task in the public interest/exercise of official authority); direct marketing and processing for the purposes of scientific/historical research and statistics.
  8. Rights in relation to automated decision making and profiling – the data subject shall have the right not to be subject to a decision based solely on automated processing where there is no human intervention.
