GDPR: DATA PRIVACY NOTICE FOR TYSON’S SHIPS RIGGERS LTD

Tyson’s’ Ships Riggers Limited are committed to protecting and respecting your privacy, in accordance with the General Data Protection Regulation (GDPR), we have implemented this privacy notice to inform you, our customers, of the types of data we process about you. We also include within this notice the reasons for processing your data, the lawful basis that permits us to process it, how long we keep your data for and your rights regarding your data. This policy together with our website privacy policy and any other documents referred to on it will help you the customer to understand our views and practices regarding your personal data and how we will treat it.

The rules on processing of personal data are set out in the General Data Protection Regulation (the “GDPR”).

  1. DEFINITIONS

Data controller – A controller determines the purposes and means of processing personal data.

Data processor – A processor is responsible for processing personal data on behalf of a controller.

Data subject – Natural person

Categories of data – Personal data and special categories of personal data

Personal data – The GDPR applies to ‘personal data’ meaning any information relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier (as explained in Article 6 of GDPR). For example name, passport number, home address or private email address. Online identifiers include IP addresses and cookies.

Special categories personal data – The GDPR refers to sensitive personal data as ‘special categories of personal data’ (as explained in Article 9 of GDPR). The special categories specifically include genetic data, and biometric data where processed to uniquely identify an individual. Other examples include racial and ethnic origin, sexual orientation, health data, and trade union membership, and political opinions, religious or philosophical beliefs.

Processing – means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Third party – means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.

DATA PROTECTION PRINCIPLES

Under GDPR, all personal data obtained and held by us must be processed according to a set of core principles. In accordance with these principles, we will ensure that:

  1. processing is fair, lawful and transparent
  2. data is collected for specific, explicit, and legitimate purposes
  3. data collected is adequate, relevant and limited to what is necessary for the purposes of processing
  4. data is kept accurate and up to date. Data which is found to be inaccurate will be rectified or erased without delay
  5. data is not kept for longer than is necessary for its given purpose
  6. data is processed in a manner that ensures appropriate security of personal data including protection against unauthorised or unlawful processing, accidental loss, destruction or damage by using appropriate technical or organisation measures

  1. THE CATEGORIES OF PERSONAL DATA CONCERNED

We process several categories of personal data on our customers in order to carry out effective and efficient processes.

Specifically, we process/hold the following types of data:

  • Customer/Business name
  • Address/Delivery Address if different
  • Contact numbers
  • E-mail address
  • Debit card, credit card or bacs payments
  • Credit insurance checks (in) Certain circumstances

We obtain your personal data from only you the customer through either telephone, e-mail or the website enquiry form.

  1. THE PURPOSE(S) OF PROCESSING YOUR PERSONAL DATA

The purpose of processing you the customer’s personal data are for the following

  1. Customer, business name and address – these are needed to allow Tyson’s Ships Riggers Ltd to process orders and for the delivery of goods. We need this data also to send invoices to customers.
  2. Contact numbers need to be processed to enable us to contact customer’s reference all aspects of their order. We can also contact the customer with any special offers that we may have.
  3. E-mail addresses – these are processed to allow us to send invoices and statements, and to enable us to respond to your enquiries received by email and any enquiries that come through the website enquiry page.
  4. Debit card, credit card and bacs payments – these need to be processed for payment of invoices.
  5. The main purpose for all of this data needing to be processed is that we (the supplier) can enter into a contract with (the customer) this contract being the exchange of goods and services.
  6. Credit Insurance checks on companies and businesses to ensure a customer is creditworthy.

Consent of the data subject
When you contact us via our website enquiry form https://www.tysonsriggers.co.uk/contact/ we need your consent to use your data you provide in the contact form to communicate with you, in particular for marketing purposes.  You have the option at any time to withdraw your consent by contacting Mr Jonathan Tyson DPO on 01472 347065.

Legitimate interest

We have a legitimate interest in processing collecting and retaining the following data  contact name/business name, full address, contact telephone/fax numbers and email addresses where permitted, debit card, credit card and BACS payments and in certain circumstances credit insurance checks for the processing of your orders, invoices and statements. You have the option to opt out of your personal data being processed for these means at any time by getting in contact with us.

Tyson’s Ships Riggers Ltd may contact you reference special offers by e-mail, telephone or post.  You have the right to ask for your data to be removed from our marketing data base and no more offers to be sent.

We have a legitimate interest in marketing our goods to existing customers to increase sales

Processing necessary for the performance of a contract with the data subject or to take steps to enter into a contract
When we take your order by telephone, fax or e-mail and ask you for all the personal data required, this is so we can enter into a contract with you the customer. This contract being the exchange of goods and services in the return for payment. We need all the personal data explained with this privacy notice for the exchange of goods and services.

 

  1. SHARING YOUR PERSONAL DATA

In the course of processing orders, we may be required to share your data, example name and address, to 3rd parties. For example courier services and credit insurance companies in certain circumstances.  Any information passed to these parties will be handled as per the GDPR guidelines and will only be relevant to the requirements of providing our services.

  1. HOW LONG DO WE KEEP YOUR PERSONAL DATA?

We only keep your data for as long as required which will be at least for the duration that you are a customer of Tyson’s Ships Riggers Ltd, we aim to keep personal data for no longer than reasonably necessary and are constantly updating our customer base by contacting the customer by telephone, post and e-mail. This is to update our data base and confirm that you are still within the industry, as soon as we find that you are not in the industry and no longer require our services, examples being retired, deceased, have a new occupation, do not require our goods and services then your personal details will be deleted from our system. If you are out of the industry and think that you may go back into the industry we will ask if it is okay to retain your personal details if you agree, they will be retained on our system until you inform us otherwise.

  1. PROVIDING US WITH YOUR PERSONAL DATA

We require your personal data as it is a requirement necessary to enter into a contract with us Tyson’s Ships Riggers Limited, with the personal data provided by you the customer we can complete our contract (The contract being the exchange of goods and services between us the supplier and you the customer). If we do not have this information we would not be able to provide our goods and services to you.

  1. YOUR RIGHTS AND YOUR PERSONAL DATA

Unless subject to an exemption under the GDPR, you have the following rights with respect to your personal data:

  1. The right to be informed about the data we hold on you and what we do with it.
  2. The right to access the personal data that we hold reference you.
  3. The right to rectification regarding any data held by us that is found to be inaccurate or out of date.
  4. The right to erasure your personal data is erased where it is no longer necessary to retain such data.
  5. The right to restrict processing, where there is a dispute in relation to the accuracy or processing of your personal data, to request a restriction is placed on further processing.
  6. The right to data portability you can request that we provide you with your personal data and where possible, to transmit that data directly to another data controller, (known as the right to data portability), (where applicable i.e. where the processing is based on consent or is necessary for the performance of a contract with the data subject and where the data controller processes the data by automated means).
  7. The right to object to the processing of personal data, (where applicable i.e. where processing is based on legitimate interests or the performance of a task in the public interest/exercise of official authority); direct marketing and processing for the purposes of scientific/historical research and statistics.
  8. Rights in relation to automated decision making and profiling – the data subject shall have the right not to be subject to a decision based solely on automated processing where there is no human intervention.
